Returns and Withdrawal Policy – Truck-Shop.pl
§1. Right of Withdrawal
- Customers who qualify as Consumers under applicable European Union consumer protection laws have the right to withdraw from a distance sales contract without giving any reason within 14 days from the date on which the Customer, or a third party indicated by the Customer other than the carrier, takes possession of the goods.
- Sole traders and self-employed individuals may also benefit from consumer protection rights where required by the applicable laws of their country of residence.
- To exercise the right of withdrawal, the Customer should register the return using the Seller's online return form.
- The withdrawal period shall be deemed observed if the Customer submits the return request before the expiry of the 14-day period.
§2. Return Registration
- To ensure efficient processing of returns, Customers should register their return through the online return portal available at:
- Upon successful registration, the Customer will receive further instructions regarding the return process.
- Returning goods without prior registration may result in delays in processing due to the need to identify the order and returned products.
§3. Effects of Withdrawal
- If the Customer validly withdraws from the contract, the contract shall be deemed cancelled.
- The Seller shall reimburse all payments received from the Customer, including the costs of the least expensive standard delivery method offered by the Seller.
- Reimbursement shall be made without undue delay and no later than 14 days from the date on which the Seller receives notice of withdrawal.
- The Seller may withhold reimbursement until the returned goods have been received or until proof of return shipment has been provided by the Customer, whichever occurs first.
- Reimbursement will be made using the same payment method used by the Customer for the original transaction unless expressly agreed otherwise.
§4. Return of Goods
- The Customer shall return the goods without undue delay and no later than 14 days after submitting the withdrawal request.
- The deadline shall be met if the Customer sends the goods before the expiry of the 14-day period.
- Unless otherwise agreed, the direct cost of returning the goods shall be borne by the Customer.
- Returned goods should be properly packed and protected against damage during transport.
§5. Returns of Truck and Automotive Parts
- Returned truck parts, commercial vehicle parts, accessories and related products must be complete and must not show signs of use beyond what is necessary to establish the nature, characteristics and functioning of the product.
- Products showing signs of installation, assembly, operation, workshop contamination, mechanical damage, traces of oil, grease, fuel, coolant or other operating fluids may be refused or may result in a reduction of the refunded amount reflecting the loss of value.
- The Customer shall be liable for any diminished value of the goods resulting from handling beyond what is necessary to establish their nature, characteristics and functioning.
§6. Business Customers
- The statutory right of withdrawal applies only where required by applicable consumer protection laws.
- Business customers who do not qualify as Consumers under applicable law are not entitled to a statutory right of withdrawal.
- Returns from business customers may be accepted solely at the Seller's discretion.
- The Seller reserves the right to refuse returns from business customers without providing a reason.
- Any approved business return may be subject to additional conditions determined by the Seller, including deductions related to handling, inspection, repackaging or restocking costs.
§7. Exceptions to the Right of Withdrawal
The right of withdrawal does not apply in cases provided for by applicable law, including but not limited to:
- Goods manufactured according to the Customer's specifications or clearly personalized.
- Sealed goods which are not suitable for return for health protection or hygiene reasons once unsealed.
- Goods which, after delivery, become inseparably mixed with other items.
- Digital content not supplied on a tangible medium where performance has begun with the Customer's prior consent.
§8. Complaints and Defective Goods
- The right of withdrawal is independent from the Customer's statutory rights relating to defective or non-conforming goods.
- Customers may submit complaints regarding goods that do not conform to the sales contract in accordance with applicable consumer protection laws.

§10. Final Provisions
- This Returns and Withdrawal Policy applies to all sales made through Truck-Shop.pl unless mandatory provisions of the Customer's country of residence provide otherwise.
- Matters not regulated herein shall be governed by the laws of Poland and applicable European Union consumer protection regulations.
- Nothing in this Policy shall limit or exclude any mandatory rights granted to Consumers under applicable law.
