TERMS AND CONDITIONS OF THE TRUCK-SHOP.PL ONLINE STORE

I. GENERAL PROVISIONS

1. GENERAL PROVISIONS

These Terms and Conditions define the rules for using the Truck-Shop.pl online store, placing distance orders, concluding sales agreements, order fulfillment, the rights and obligations of the Seller and Customers, as well as the rules for withdrawal from the agreement and complaint procedures.

These Terms and Conditions are made available free of charge on the Store’s website in a manner allowing their download, storage, and printing.

Placing an order constitutes acceptance of these Terms and Conditions.

2. SELLER

The online store Truck-Shop.pl is operated by Truck-Shop Spółka z ograniczoną odpowiedzialnością with its registered office in Pruszcz Gdański, ul. Nowowiejskiego 28, 83-000 Pruszcz Gdański, Poland, entered into the Register of Entrepreneurs of the National Court Register under KRS number 0000384829, NIP 604-014-73-10, REGON 221222531.

3. BUSINESS ACTIVITY

Truck-Shop.pl sells automotive parts and accessories via the website https://www.truck-shop.pl.

4. DEFINITIONS

Customer – a natural person, legal entity, or organizational unit without legal personality making purchases in the Store.

Consumer – a natural person performing a legal act with the Seller not directly related to their business or professional activity.

Entrepreneur with Consumer Rights – a natural person conducting business activity who enters into an agreement directly related to their business activity, when it follows from the agreement that it is not of a professional nature for that person.

5. PRODUCTS

All products offered in the Store are brand new, free from physical and legal defects, and have been legally introduced to the market.

6. PRODUCT INFORMATION AND PRICES

Information presented on the Store’s website does not constitute an offer within the meaning of the Civil Code but an invitation to conclude an agreement.

Product prices displayed in the Store are given in Polish zloty (PLN) and include VAT (gross prices).

The price displayed next to the product is binding at the moment the Customer places the order.

Delivery costs are added according to the selected delivery method.

In the case of promotions and discounts, the Seller informs Customers about the lowest price of the product valid within 30 days before the reduction.

7. SALES DOCUMENTS

A VAT invoice or fiscal receipt is issued for every order.

II. ORDERS

8. PLACING ORDERS

Orders may be placed:

In order to place an order, the Customer is required to provide data necessary for order fulfillment.

9. ORDER CONFIRMATION

After placing an order, the Customer receives an e-mail confirming acceptance of the order for processing.

10. CONCLUSION OF THE SALES AGREEMENT

The sales agreement is concluded when the Seller confirms acceptance of the order for processing.

11. REFUSAL TO PROCESS AN ORDER

The Seller reserves the right to refuse order fulfillment in the following cases:

  • providing incorrect Customer data,
  • product unavailability,
  • technical errors or obvious pricing mistakes.

12. ORDER CANCELLATION

The Customer may cancel the order until the shipment is handed over to the carrier.

13. ORDER PROCESSING TIME

The order processing time is from 1 to 14 business days unless otherwise specified for a product.

If the product is unavailable, the Customer will be informed immediately about the expected delivery date.

14. FORCE MAJEURE

The Seller shall not be liable for delays or failure to perform the order resulting from force majeure.

15. ORDER DELIVERY

Ordered products are delivered via courier companies and logistics operators.

Domestic deliveries are carried out via:

  • DPD – delivery cost: PLN 9.90 gross,
  • InPost Parcel Lockers – delivery cost: PLN 9.90 gross.

Domestic shipments are usually delivered within 1–3 business days from dispatch.

Products may also be collected personally after prior arrangement.

International delivery costs are:

  • Czech Republic – DPD: PLN 35.00,
  • France – DPD: PLN 170.00,
  • Ireland – DPD: PLN 155.00,
  • Lithuania – DPD: PLN 70.00,
  • Germany – DPD: PLN 50.00,
  • Romania – DPD: PLN 150.00.

Delivery costs to other countries are determined individually.

16. PAYMENTS

Payments for ordered products may be made via:

  • bank transfer,
  • AUTOPAY payment system,
  • STRIPE payment system,
  • payment card,
  • Google Pay,
  • BLIK,
  • cash on delivery (available only in Poland).

For electronic payments, order processing begins after payment confirmation.

III. WITHDRAWAL FROM THE AGREEMENT

17. RIGHT OF WITHDRAWAL

Consumers and Entrepreneurs with Consumer Rights have the right to withdraw from a distance agreement within 14 days without giving any reason.

The withdrawal period starts from the day the Consumer or a third party indicated by the Consumer takes possession of the product.

To meet the deadline, it is sufficient to send the withdrawal statement before the deadline expires.

18. EFFECTS OF WITHDRAWAL

In the event of withdrawal from the agreement, the Seller shall refund all payments received from the Consumer, including delivery costs, within no later than 14 days from receipt of the withdrawal statement.

Refunds will be made using the same payment method used by the Consumer unless the Consumer agrees otherwise.

19. RETURN OF PRODUCTS

The Consumer is obliged to return the product immediately, no later than 14 days from withdrawal from the agreement.

The direct cost of returning the product shall be borne by the Consumer.

20. EXCEPTIONS TO THE RIGHT OF WITHDRAWAL

The right of withdrawal does not apply in the cases specified in Article 38 of the Polish Consumer Rights Act.

IV. COMPLAINTS AND PRODUCT CONFORMITY

21. SELLER’S LIABILITY

The Seller is liable to the Consumer for any lack of conformity of the product with the agreement existing at the time of delivery and revealed within two years from that moment.

22. SUBMITTING COMPLAINTS

Complaints may be submitted:

A complaint should include:

  • Customer details,
  • order number,
  • description of the issue,
  • Customer’s request.

Original product packaging is not required to submit a complaint.

23. COMPLAINT PROCESSING TIME

The Seller shall process complaints within 14 calendar days from receipt.

24. METHODS OF COMPLAINT RESOLUTION

If a product is found to be non-compliant with the agreement, the Consumer may request:

  • repair of the product,
  • replacement of the product,
  • price reduction,
  • withdrawal from the agreement if the defect is significant.

25. TRANSPORT DAMAGE

Customers are advised to inspect shipments upon delivery.

If shipment damage is detected, it is recommended to prepare a damage report with the carrier; however, the absence of such report does not deprive the Consumer of the right to file a complaint.

26. WARRANTY

If a product is covered by a manufacturer’s warranty, information regarding the warranty terms is attached to the product or published on the product page.

Using the warranty does not exclude, limit, or suspend the Consumer’s rights arising from statutory provisions regarding conformity of goods with the agreement.

V. PERSONAL DATA PROTECTION

27. PERSONAL DATA

The controller of personal data is Truck-Shop Sp. z o.o. with its registered office in Pruszcz Gdański.

Personal data are processed in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council (GDPR) and the applicable Polish data protection regulations.

Personal data are processed for the purposes of:

  • order fulfillment,
  • Customer account management,
  • contact with Customers,
  • fulfillment of legal obligations,
  • marketing activities – only upon obtaining the Customer’s consent.

Customers have the right to:

  • access their personal data,
  • rectify data,
  • erase data,
  • restrict processing,
  • transfer data,
  • object to processing,
  • withdraw consent,
  • lodge a complaint with the President of the Personal Data Protection Office.

Data may be transferred to electronic payment providers, courier companies, and IT service providers only to the extent necessary for order fulfillment.

Data shall be stored for the period required by law or until consent is withdrawn.

28. NEWSLETTER

Customers may consent to receive newsletters and commercial information electronically.

Consent may be withdrawn at any time by sending an e-mail to info@truck-shop.pl.

29. COOKIES

The online store uses cookies for the proper functioning of the website, traffic analysis, and marketing activities.

VI. OUT-OF-COURT DISPUTE RESOLUTION

30. OUT-OF-COURT DISPUTE RESOLUTION

Consumers may use out-of-court complaint and claim resolution methods in accordance with applicable law.

VII. FINAL PROVISIONS

31. FINAL PROVISIONS

In matters not regulated by these Terms and Conditions, the provisions of Polish law shall apply, in particular:

  • the Civil Code,
  • the Consumer Rights Act,
  • the Act on Providing Services by Electronic Means,
  • GDPR.

The competent court shall be determined according to generally applicable law.

These Terms and Conditions enter into force on the date of publication on the Store’s website.
